We do not sell, rent, or distribute personal information to unauthorized third parties.

1.4 Legal Basis (GDPR)

Processing is conducted under Article 6(1)(b) of Regulation (EU) 2016/679 (GDPR) for the performance of a contract or pre-contractual measures, and under Article 6(1)(f) for legitimate interests in improving our services. Where consent is required, it is obtained explicitly and may be withdrawn at any time.

1.5 Data Retention

Personal data is retained for the duration necessary to fulfill the purposes for which it was collected, typically up to 24 months after the last communication. 1.8 International Transfers

All personal data is processed within the European Economic Area (EEA). Where data is transferred outside the EEA, we ensure adequate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission.

2.1 Scope of Agreement

These Terms of Service govern the provision of digital engineering, cloud infrastructure, and server logic services by DigitalPatternWorks, registered at Calle Hormigo, 11, 28904 Getafe, Madrid, Spain. All services are delivered under explicitly contracted Statements of Work (SOW) executed between the Client and DigitalPatternWorks.

2.2 Service Delivery

DigitalPatternWorks commits to delivering services in accordance with the specifications outlined in the applicable SOW. Project timelines, deliverables, and acceptance criteria are defined at the commencement of each engagement. Delivery timelines are estimates and may be adjusted through mutual written agreement.

2.3 Payment Terms

Invoices are payable within 14 calendar days of issuance unless otherwise agreed in the SOW. Late payments may incur interest at a rate of 0.05% per day on the outstanding balance. DigitalPatternWorks reserves the right to suspend services in the event of non-payment after a 7-day grace period.

2.4 Intellectual Property

Upon complete settlement of all agreed commercial invoices, DigitalPatternWorks assigns all worldwide intellectual property rights in the client-specific software deliverables, design tokens, and digital assets directly to the Client. Pre-existing frameworks, tools, and libraries used in development remain the property of DigitalPatternWorks under a perpetual, irrevocable license.

2.5 Limitation of Liability

DigitalPatternWorks' total aggregate liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. DigitalPatternWorks shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities.

2.6 Confidentiality

Both parties agree to maintain the confidentiality of proprietary information disclosed during the course of an engagement. This obligation survives termination of the agreement for a period of 3 years.

2.7 Governing Law

These Terms are governed by the laws of the Kingdom of Spain. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain.

3.1 What Are Cookies

4.1 Eligibility for Refunds

DigitalPatternWorks offers refunds in accordance with Spanish consumer protection regulations (Real Decreto Legislativo 1/2007). If services have not yet been commenced, you may request a full refund within 14 calendar days of payment.

4.2 Partial Refunds

Where services have been partially delivered, a proportional refund may be issued based on the percentage of work completed relative to the total SOW scope. Completed deliverables and associated intellectual property shall remain with the Client in the event of a partial refund.

4.3 Non-Refundable Items

The following are non-refundable: (a) work already completed and delivered under an approved SOW milestone; (b) third-party licensing fees incurred on behalf of the Client; (c) domain registration and hosting fees already processed; (d) SLA retainer fees for months in which services were rendered.

4.4 Refund Process

To request a refund, contact DigitalPatternWorks at [email protected] with your project reference and reason for the request. Refund requests are reviewed within 5 business days. Approved refunds are processed to the original payment method within 10 business days.

4.5 Dispute Resolution

In the event of a dispute regarding refund eligibility, both parties agree to attempt resolution through good-faith negotiation before pursuing formal dispute resolution. Unresolved disputes shall be submitted to the competent courts of Madrid, Spain, in accordance with applicable law.
